These terms and conditions (Terms) apply to and regulate operation of registrations offered in the website http://www.goaguesthomes.com to Customers (Leasers). These Terms shall be in addition to any other terms as stipulated by Ms. Goa Guest Homes. In these Terms and conditions, the following words and phrases have the meaning stated hereunder unless indicated otherwise: A) DEFINITIONS: ’Website’: Refers to the website owned, established and maintained by M/s Goa Guest Homes and known on the Universal Resource Locator (URL) as http://www.goaguesthomes.com ’Advertiser’: Refers to the firm M/s Goa Guest Homes having its registered office at “Shalom”, House No-96, Ambeaxir, Sernabatim, Colva, Salcette-Goa. ”Leaser”: Refers to the owner, manager or the authorized signatory, of the premise to be registered on the website. ”Guest”: Refers to the customers/potential customers of the Leaser whom may wish/intend to use the services and facilities of the Leaser. ”Premise”: Refers to the property of the Leaser intended for renting out to guests. B) APPLICABILITY OF TERMS The terms form the contract between the Leaser (customer) and M/s Goa Guest Homes. The Leaser shall apply to M/s Goa Guest Homes in the prescribed form for registrations of the premise on the website and availing of the related services. By applying for registration the Leaser acknowledges that he/she has/have read, understood and accepted these terms and conditions. C) CONDITIONS FOR APPLICABILITY: The Advertiser owns and manages the website with an intention of advertising premises on rent, sale, etc. on the World Wide Web The Advertiser is willing to undertake bookings on behalf of the Leaser, for a monetary consideration The leaser owning/managing a premise for rent, sale, etc. intends to advertise the premise on the World Wide Web through the Website and agrees to accept bookings from the advertiser D) CHANGE OF TERMS M/s Goa Guest Homes shall have the absolute discretion to amend or supplement any of the terms at any time. M/s Goa Guest Homes may communicate the amended terms by posting the same on the website or in any other manner as decided by M/s Goa Guest Homes. The Leaser shall be responsible for regularly reviewing these terms including amendments thereto as may be posted on the website. E) WEB ADVERTISING 1. The Leaser agrees to pay the Advertiser the stipulated annual registration charge, for the registration and posting of the premise on the website for a period of 12 months. 2. The registration period begins from the day the information regarding the premise has been posted / uploaded onto the website. 3. The Advertiser reserves the right to change the registration charge, as deemed fit, at any point of time without being bound to issue a notice to the Leaser. However, registration charge already paid will remain unaffected till the validity of the registration. 4. Benefits of all software updates, new facilities, improvements, etc., unless deemed chargeable by the Advertiser, will be accrued to the Leaser. 5. All information provided should be true and verifiable. Submission of false and misleading data will amount to breach of contract and invite legal action and/or permanent cancellation of contract. PREMISE BOOKINGS 6. The advertiser agrees to entertain all inquiries / requests for accommodation or otherwise, with regards to the premise, on its website or otherwise. 7. On receiving requests/inquiries, the Advertiser will consult the leaser and confirm availability and rates inclusive of the Advertisers fees in case of confirmations. 8. The Advertiser agrees to pay 50% of the fees at the time of booking after deducting the Advertiser’s charges. The balance payment will be made before occupation of the premises. 9. A standard short term Agreement will be entered into with the Guest by the Advertiser and as confirmed by the leaser. 10. The leaser is bound to provide to the Guest all facilities as declared available on the website and as confirmed on the standard short term Agreement. 11. The advertiser agrees to make maximum effort , within his means , but not binding, to promote the website as much as possible all over the world. 12. The leaser agrees and accepts that the primary activity of the website is advertising the information provided by the leaser and as such, the Advertiser is not liable to compulsorily confirm bookings for any premises and that this activity is merely a supporting facility provided to encourage business of both parties. 13. The Advertiser will provide ratings based on customer feedback and other parameters as will be intimated to the leaser before the ratings begin DISCLAIMER 14. All information on this website, is provided free of cost for personal perusal ONLY, and as such, is made available “AS IS”.
